Terms of Service

These Terms of Service (“Terms”) apply to your access and use of Nattr’s mobile application (the “App”), Nattr’s website (“Site”), and other online products and services (collectively, the “Service”).
Points of Focus
1) Don’t post, link or otherwise make available on or through Nattr any of the following:
* Content that is illegal or unlawful;
* Content that may infringe or violate any rights of any party; and
* Viruses, corrupted data or other harmful, disruptive or destructive files or code.
* Create an account or post any content if you are not over 13 years of age;
* Use Nattr in any manner that could interfere with, disrupt, negatively affect or inhibit other Nattr users or that could damage, disable, overburden or impair the functioning of Nattr;
* Collect any personal information about other users, or intimidate, threaten, stalk or otherwise harass other Nattr users;
* Circumvent or attempt to circumvent any features designed to protect Nattr, Nattr users, or third parties.
3) We change these Terms of Service every so often. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, may provide you with an additional notice (such as on our homepage or over email).
4) These terms are between you and Nattr, and not with Apple, Inc. While you may be subject to certain terms and conditions with Apple, Inc. by using Apple’s App Store or other products, these terms are specifically between You and Nattr. Your use of the Nattr Service is governed solely by these terms.
5) If you access or use Nattr, it means you agree to all the terms below
By using our Services, you are agreeing to these Terms. Please read them carefully.
Sometimes additional terms, requirements (such as age requirements) or policies will apply to different parts of our Services. Where this is the case, we will bring the additional terms, requirements and policies to your attention when you are using those particular services within the Service and they will become part of these Terms.
This is the agreement we need to make with you, in order that you can sign up and start benefitting from Nattr.
Code of Conduct
We want everyone to enjoy being part of our trusted community. We need everyone to commit to the following rules – which includes you if you are to use the Service:
* You must follow and abide by these Terms when you use the Service.
* You will not use Nattr to do anything unlawful, misleading, malicious, or discriminatory.
* You will not send or otherwise post unauthorised commercial communications (such as spam) on Nattr.
* You will not impersonate any person or organisation, or falsely state your affiliation with a person or organisation.
* You will not collect users’ content or information, or otherwise access Nattr, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
* You may not misuse our Service; for example, do not interfere with our Service or try to access it using a method other than the interface and the instructions that we provide.
* You will not do anything that could disable, overburden, or impair the proper working of Nattr, such as a denial of service attack.
* You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Nattr.
* You will not upload viruses or other malicious code.
* You will not solicit login information or access an account belonging to someone else.
* You will not bully, intimidate, or harass any user.
* You will not post content that is hateful, threatening, pornographic, incites violence, or contains graphic or gratuitous violence.
* You will not facilitate or encourage any violations of these Terms.
We may suspend or stop providing our Service to you if you do not comply with our Terms or policies or if we are investigating suspected misconduct.
If you do any of these things, we may close your Nattr account.
Security & Registration
Here are some commitments you make to us relating to registering and maintaining the security of your account:
* You will not create an account for anyone other than yourself without permission.
* If we disable your account, you will not create another one without our permission.
* You will not use Nattr if you are under 13.
* You will not share your password or let anyone else access your account, or do anything else that might jeopardise the security of your account.
* You will not transfer your account (including any page or application you administer) to anyone without first getting our written permission.
* If you select a username for your account we reserve the right to remove or reclaim it if we believe appropriate.

Your Nattr account is unique to you. Treat it carefully and keep it to yourself. If you lose your account for breaking the rules, you don’t have a right to another one.
We may collect money for aspects of our services, which will be detailed within the app.
We may also pay money out at certain times for aspects of our services – and if you are one of those people who will receive money, we will communicate with you by email about this.
All sums payable by Nattr or by you are exclusive of VAT (and all other applicable taxes, duties and levies). If these are applicable at any time, they shall be payable by the paying party at whatever rate (and in whatever manner) is set by law. We will choose the currency of all payments which we make and we will choose the currency of all payments which we are to receive. (We may also use a third party to provide collection or payment services, as we see fit and we can always specify how any payments to or from Nattr are to be made.)
You have no right to set-off any debts or payments due to Nattr. However, we may set off any amounts due and payable to you, against any other amounts due and payable by you to Nattr.
*Subscriptions last one month and will be auto-renewed every month thereafter. Payment will be charged to iTunes Account at the time of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
The account will be charged the cost of renewal $13.99 within 24 hours prior to the end of the current period.
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings after purchase and any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable

You can manage your subscriptions and turn off auto-renewal by going to Account Settings after purchase.
No cancellation of the current subscription is allowed during the current subscription period.
PLEASE DO NOT SHARE ANY PERSONAL DETAILS ABOUT YOURSELF OR OTHERS IN APP. Any publicly shared content deemed to contain private content may be removed at any time.
In connection with your use of the Service, we may send you service announcements, administrative messages and other information. You may opt out of some of those communications.
Your Responses, Information and Content
Your trust is important to us and we take our responsibilities seriously. On Nattr we will act transparently as to how your content is used and how to delete your content. Remember that all responses that you post on Nattr are publicly displayed. If you own any intellectual property rights in your content, you will continue to retain ownership of those rights, subject to the licence terms with Nattr.
Because the essence of Nattr is to share your content, you grant to us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use the content that you post on Nattr, including for use on other media. This licence ends when your content is deleted. Make sure that you have the necessary rights to grant us this licence for any content you submit to our Service.
Here are a couple examples that you will be familiar with:
* We display your uploaded messages so that the rest of the world can see them
* We connect responses together so you can get the best answer possible
This is how you delete any free text content you submit to Nattr – send an email to email@example.com specifying exactly which content that you wish to be deleted. Please note that any old content that you have submitted may or may not be removed at the discretion of Nattr. This is to ensure continuity of discussions and contributions of the Nattr community.
We can remove any content or information you post on Nattr if we believe that it violates our Terms.
Please note that content that is deleted from Nattr’s Service may remain in back-up storage for some period of time. Such content may also be anonymised and aggregated and used for various purposes such as research and analysis.
Other’s Rights, Information and Content
We respect other people’s rights, and expect you to do the same. You will not post content or take any action on Nattr that infringes or violates someone else’s rights or otherwise violates the law.
You may not use content from our Service unless you obtain permission from its owner or are otherwise permitted by law. Our Service displays some content that is not Nattr’s.
This content is the sole responsibility of the entity that makes it available.

We’ll respect your copyright, please respect other people’s. If you see something that’s an issue, let us know.
Our rights when we provide the Service
We are constantly changing and improving our Services. We may add or remove functionalities or features and we may suspend or stop part of the Service altogether.
Occasionally, we may have to:
* interrupt the Service (or a part of it). If we do so, we will restore it as quickly as we can; and/or
* make changes to certain technical specifications and product features.
Branding, trade marks, service marks and logos used in our Service may belong to Nattr or other persons. These Terms do not grant you the right to use them. Using our Service
does not give you ownership of any intellectual property rights in our Service or the content that you access.
Nattr gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the platform and software provided to you as part of the Service. This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by Nattr in the manner permitted by these Terms. You may not use Nattr for any commercial purposes unless you have our prior written permission. You may not copy, modify, distribute, sell or lease any part of our Service or included platform or software, nor may you reverse engineer or attempt to extract the source code of that platform or software, unless laws prohibit those restrictions or you have our written permission.
We’re always trying to make Nattr better, and we may add or remove elements of the Service in order to do that.
This may also mean occasionally interrupting the Service, but if we do that we’ll try to make it quick.
Using Nattr does not mean Nattr logos or trade marks are yours, nor can you clone or misuse the technology that makes Nattr work.
Where applicable laws require, we will respond to legitimate requests by authorities or court orders to disclose information. In serious instances of abuse we may also notify the police or relevant law enforcement agency.
Nattr cannot and does not monitor content of our users’ content or communications and therefore Nattr cannot and does not guarantee that our application is free of illegal material or other content that may be considered unacceptable. When any content may be specifically brought to our notice, we may review that content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law.
If anything illegal is reported to us and it checks out as illegal (or we reasonably believe it to be so), we may pass it on to the police.
If there’s a legal request to share your information, that comes from a legitimate authority, we’ll have to do that.
Changing our Terms
We may update our Terms for various reasons, for example, to take into account changes in our Service, the law or to deal with gaps in our Terms.
If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, may provide you with an additional notice (such as on our homepage or over email). You should look at these Terms regularly.
Where we believe that a change is likely to cause you material disadvantage, we will let you know about the change at least 28 days before it happens.
However, changes in our Terms relating to new functions for a part of the Service or changes made for legal reasons will be effective immediately.
If you do not agree to any changes, you should discontinue your use of our Service. Refer to ‘Ending the Service’ below for more information about how to delete your account.
If you breach these Terms
If you violate the letter or spirit of these Terms, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of the Service to you. We will notify you by email or at the next time you attempt to access your account. We may also delete your account. In all such cases, our agreement will come to an end.
Sometimes we may choose to ignore it if you break these Terms, or we may choose not to enforce a particular term. But even if we do this, in the future, we can still choose to enforce that term or take action because you broke that or any other of these Terms.
If you don’t keep to the rules set out here, it’s up to us how we respond, but we may close your account.
Ending the Service
In addition to our other rights, we may also stop providing our Service to you or add or create new limits to our Service by giving you 28 days’ written notice.
We believe that you own your data, and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from the Service.
We’d hate you to leave but, if you do want to, we defend your right to go.
Our responsibility when providing the Service
We provide our Service using reasonable skill and care and we hope that you will enjoy using it. But there are certain things that we do not promise about our Service.
Unfortunately, we cannot guarantee that our Service will never be faulty.
Other than as expressly set out in these Terms, neither Nattr nor its suppliers or distributors makes any specific promises about the Service. For example, we do not make any commitments about the content within the Service, the specific functions of the Service or their reliability, availability or ability to meet your needs.
Some jurisdictions provide for certain conditions and warranties inserted by law. Except as expressly stated in these Terms, all warranties and conditions, whether express or implied by statute, common law or otherwise are hereby excluded to the extent permitted by law.
This section of the Terms (called ‘Our responsibility to you when we provide the Service’) prevails over all other parts of the Terms and sets out our entire liability and your sole and exclusive remedies in respect of: (i) the performance, non-performance or purported performance of these Terms and any services (including, without limitation the Service); or (ii) otherwise in relation to these Terms or the entering into or performance of these Terms or any services (including, without limitation, the Service).
We do not exclude or limit liability for: (i) death or personal injury resulting from negligence (as such term is defined in the Unfair Contract Terms Act 1977); or (ii) any breach of any undertaking as to title, quiet possession and freedom from encumbrance implied by law; (iii) any fraudulent misrepresentation or fundamental misrepresentation on Nattr’s part; or (iv) any other liability that cannot be excluded by law. We call this paragraph our “Mandatory Responsibilities”.
Apart from the Mandatory Responsibilities, Nattr’s total liability for loss of or damage arising out of or in connection with any claim you may have against us (including, without limitation the Service) (which we call a “Claim” for short), shall not exceed the greater of: (i) maximum of 110% of any fees you have paid (or which are payable to) us for the relevant services in the 12 months before the Claim arose; or (ii) maximum of 110% of any monies we have paid you in respect of relevant services in the 12 months before the Claim arose; or (iii) £5.
Also, apart from the Mandatory Responsibilities, Nattr shall not be under any liability for:
(a) loss of actual or anticipated profits;
(b) loss of goodwill;
(c) loss of business;
(d) loss of revenue or of the use of money;
(e) loss of contracts;
(f) loss of anticipated savings;
(g) loss of data and/or undertaking the restoration of data or software restoration; or
(h) any special, indirect or consequential loss;
and such liability is excluded whether it is foreseeable, known, foreseen or otherwise. For the avoidance of any doubt, (a) to (g) above apply whether such damage or loss is direct, indirect, consequential or otherwise.
We will not be liable to you for any losses that you may suffer if you have used our Services for business purposes.
We recognise that in some countries, you might have legal rights as a consumer. If you are using the Service for a personal purpose, then nothing in these Terms limits any consumers’ legal rights which may not be waived by contract.
Matters beyond reasonable control
Sometimes we may not be able to do what we have agreed because of something beyond our reasonable control, which may include (without limitation): lightning, flood, severe weather, fire, explosion, terrorist activities, anything done by Government or other competent authority, or industrial disputes. There may be other reasons too. In these cases, we do not accept responsibility for not providing you with the Service.

These Terms make up the entire agreement between the parties regarding our Services, and supersedes any prior agreements. These Terms and our relationship will be governed by the laws of England. You agree to submit to the exclusive jurisdiction of the English courts.
You accept that this agreement for our Services is personal to you and agree not to transfer it to anyone else, or to try to do so. However, we may take instructions from a person whom we think, with good reason, is acting with your permission. We can transfer this agreement for our Service to another company
After these Terms come to an end, the provisions of this agreement, which by their nature extend beyond the termination, will survive termination of the agreement or termination of your use or access to all or any portion of our Service.
No third party is entitled to enforce any term under this agreement under the Contracts (Rights of Third Parties) Act 1999.
If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.
We’re based in the UK, and operate under English law.
Nattr is a trademark of Nattr Ltd. Use of “Nattr” in this document means Nattr Ltd and any of its subsidiaries or affiliates.
